Well that was the question facing Judge John Tomasello in Salem, N.J. when a custody battle came before him over who should have the custody of a Pug named Dexter.In previous court cases it had been ruled that a dog (or a cat) were not children and should, therefore, be treated as a piece of property like the television or DVD player.
However Judge Tomasello ordered that the dog should spend an equal amount of time with the fighting couple – Doreen Houseman and Eric Dare.
The ruling by the Judge is expected to influence future dog custody cases.
For the case to come to court and be settle it cost Doreen and Eric a total of around $40,000
